GAO Audit Report Prompts Legislative Action on Recalls

Willie Bryant We discussed the Government Accountability Office (GAO) conducting a review and analysis of food recalls in two areas: beef and beef products sold to or through the USDA’s commodity products program to school districts across the nation, and canned vegetable products sold directly to school districts for the school lunch program by wholesale food distributors. As a result of the GAO report, one bill has been introduced and a second companion bill is on the way.

A quick review of the FDA’s recent recall list shows the usual suspects – Beef Filet dog treats, Boiled Horse Mackerel, and Chocolate Pecan Caramel Stars, just to name a few. And most recently, recalls of name brand over-the-counter cold medications. But one item you don’t see on the list is wooden shipping pallets. Should there be cooperation between the FDA and other agencies on the regulation of things like wooden pallets?

The Consumer Product Safety Commission announced on December 24, 2009, that the agency voted unanimously on registration requirements for durable infant or toddler products. While we’ve previously mentioned the new rule on this blog, as recall experts we want to ensure it receives the attention it deserves. This new rule creates one more path to follow to achieve regulatory compliance, while also affecting the entire recall planning and communication process.

Did you know that the Consumer Product Safety Commission (CPSC) has the authority to recall a consumer product that endangers the public, even when the product does not violate any specific CPSC regulations? It’s true – the Federal Hazardous Substances Act grants the CPSC that power. The agency has exercised that power before for lead, and now manufacturers must be prepared in case the agency does the same for cadmium. It’s a constant reminder that regulatory compliance is a moving target, and recall preparedness and having recall strategies in place is critical.
