Regulatory agencies are not the only groups concerned about safety. Consumer advocacy organizations and institutions of higher education are also keenly interested in protecting consumers. As we have discussed here before, research and product testing by any of these groups can have an influence on the recall process. In a recent study, Jefferson Medical College found that ceramics sold in Philadelphia’s Chinatown contain levels of lead that exceeded the Food and Drug Administration (FDA)’s safety standards.

Consumers Don’t Trust Corporate Recall Management

Surprising findings from a recent Consumer Reports National Research Center study show the extent to which consumers distrust corporate recall management and misunderstand the recall process. It is difficult to measure accurately the validity of the study’s finding that 40 percent of American consumers worry they are not getting the product recall notification and information they need from companies. But it is easy for all of us, as consumers, to relate to concerns associated with the risk of unsafe products.

Consumer Product Safety Commission Chairman Inez Tenenbaum offered welcome news to the makers of baby cribs, toys, strollers and other children’s products recently when she asserted that her federal regulatory body will take special care to make its decisions based on science, not politics, and that she looks forward to a continued partnership with the industries she regulates. Not only will this approach affect whether companies need to make modifications to the products they have manufactured for years, but it most assuredly will impact the recall process and could make the difference between whether a manufacturer must manage a recall.

Track-and-Trace Initiative Coming to the Pharmaceutical Industry

Like it or not, track-and-trace may soon be a reality for the pharmaceutical industry. Earlier this month, the Obama administration recommended implementation of a track-and-trace initiative as part of a package of proposals designed to fight counterfeit drugs and protect consumers. While several industry organizations have expressed concerns about the cost involved, if there is anything recent regulatory events can tell us, it is that companies are better off running to the light and embracing new consumer protection mechanisms than pushing back against regulators.
