In the midst of a difficult or complicated recall, partnering with a reverse logistics and recall management company can help facilitate coordination between manufacturers and regulators and avoid tensions that could grow into regulatory or litigation problems. This past month, for example, a food packing company at the center of a recent hazelnut recall demonstrated how a lack of transparency in recall procedures, compounded by poor communication between companies and regulators can spiral out of control without the proper guidance that reverse logistics firms provide.

When an over-the-counter drug is recalled, consumers are generally aware of the immediate impact. The recall process requires that affected products are removed from store shelves. Consumers are warned to discontinue use of the drug in order to protect themselves against any health risks the recalled drug may pose. But effective recall management also means that safe products quickly replace the recalled drugs in order to make sure that consumers always have the medications they need.

Improving the food safety process has been a hot topic over the past few months. In addition to the FDA taking initial steps necessary to implement new food safety legislation, the Government Accountability Office (GAO) has now released a report that calls for the consolidation of 15 federal food safety agencies. What exactly all this food safety reform means for the recall process remains to be seen. But as part of your recall planning, you should be studying both enacted and recommended food safety modifications and adapting your recall management policies accordingly.

The Consumer Product Safety Commission’s (CPSC) new consumer recall complaint database, SaferProducts.gov, is set to launch today. This new database, mandated by the Consumer Product Safety Improvement Act (CPSIA) enacted more than two years ago, will likely have a major impact on consumer buying decisions and on companies that manufacture consumer goods. The CPSIA itself, which makes changes to various standards and regulations including policies governing recall management, has been praised by consumer safety groups and criticized by industry. Much of that criticism has focused on the consumer product database.

While Toyota can breathe a short sigh of relief that the National Highway Traffic Safety Administration (NHTSA) recently closed its investigation into sudden acceleration reports, the Japanese automaker certainly is not out of the woods. Since Toyota’s problems began, the company has paid more than $48 million in government fines for failures related to recall management. And the automaker is still dealing with scores of lawsuits filed by Toyota owners since the first recall was announced in September 2009.
