Effective Recall Management Only One Piece of the Consumer Protection Pie

While we often discuss the importance of effective recall management, our ultimate goal is always to help manufacturers and retailers protect consumers. With that in mind, I am pleased to say that I was present for an historic occasion during this year’s Food Marketing Institute Midwinter Executive Conference in Phoenix. The FMI and the Grocery Manufacturers Association announced the launch of their Nutrition Keys program, including voluntary labeling system that will give consumers important nutritional information on the front of the product’s package.

With the New Year upon us, reflecting on the events of the last 12 months can be a valuable learning experience. For some, one of the most memorable aspects of 2010 was number of recall announcements and recall management efforts by some the most popular and well-known consumer brands. During the year there were recalls of more than 500 million eggs, 5.5 million Toyota vehicles and 12 million cadmium-tainted drinking glasses, just to name a few. It was apparent that regulatory agencies made consumer protection a priority in 2010. And you should do the same in 2011.

With so much regulatory activity, manufacturers, distributors, and retailers may feel like they are under attack and be tempted to take a defensive position. But understanding that the CPSC’s mission is to protect the public – not to take down companies – can go a long way toward minimizing recall risks, opening lines of communication with regulators, and protecting the public from unnecessary risks.

Pharma Companies May Face FDA-Mandated Recalls

Recent Congressional developments suggest that more changes to recall regulation are still to come. In fact, a new bill introduced in the House of Representatives could give the Food and Drug Administration (FDA) mandatory recall authority over pharmaceutical products. The pharmaceutical industry could soon face the same risks and costs the food industry will experience when adapting their recall plans and recall processes to effectively manage a recall demanded by the FDA.

Concern About Cadmium Means Companies Must Stay Vigilant

Because cadmium is inexpensive and shares similar weight properties with lead, it has become the lead substitute of choice for children’s toy and jewelry manufacturers. According to the American Academy of Pediatrics (AAP), however, cadmium may not be any safe for children than the lead it replaces. The head of the Consumer Product Safety Commission (CPSC) has even gone so far as to call cadmium the “new lead,” signaling a sharp increase in regulatory concern and attention.
